These Terms and Conditions govern your use of digital downloads, including PDF books, 360 images, and other digital media (referred to collectively as “Digital Downloads”) provided by Simcoemedia (“we”, “us”, or “our”). By purchasing, downloading, or using any Digital Downloads from our website, you agree to be bound by these Terms and Conditions.
License
Upon purchasing a Digital Download from our website, you are granted a non-exclusive, non-transferable license to use the Digital Download in accordance with the license type specified at the time of purchase. License types may include:
- Personal Use: This license grants you the right to use the Digital Download for non-commercial purposes, limited to your personal use. For example, using the digital media as a skybox on Meta Quest or Apple Vision Pro.
- Commercial Use: This license grants you the right to use the Digital Download for commercial purposes, such as in computer games, distributable apps, or as backgrounds in media projects, including projections in public places.
Restrictions
Regardless of the license type, the following restrictions apply to all Digital Downloads:
- Under no circumstances should the Digital Download be published on social media platforms, resold, or distributed in any manner without prior written consent from Simcoemedia.
- You may not modify, adapt, sublicense, or create derivative works based on the Digital Download, unless expressly permitted by us.
- You may not remove any copyright or proprietary notices included in the Digital Download.
Intellectual Property
All rights, title, and interest in and to the Digital Downloads, including all intellectual property rights, are and shall remain owned by Simcoemedia. Your use of the Digital Downloads does not grant you any ownership rights or licenses, except for the rights expressly granted under these Terms and Conditions.
Disclaimer of Warranties
The Digital Downloads are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. We do not warrant that the Digital Downloads will be error-free or uninterrupted, nor do we make any representations regarding the use or results of the Digital Downloads in terms of accuracy, reliability, or otherwise.
Limitation of Liability
In no event shall Simcoemedia, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Digital Downloads; (ii) any conduct or content of any third party on the Digital Downloads; (iii) any content obtained from the Digital Downloads; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom without regard to its conflict of law provisions.
Changes to Terms and Conditions
We reserve the right to update or change these Terms and Conditions at any time without prior notice. Your continued use of the Digital Downloads after any such changes constitutes your acceptance of the new Terms and Conditions.
